Return and Cancellation Policy
At Alba Ruiz Art we want you to be completely satisfied with your art acquisition.
Below are the terms and conditions governing returns and cancellations, in compliance with consumer protection regulations.
1. Right of Withdrawal (Change of Mind)
If you are a private consumer and purchased a ready-made artwork from our online store, you have the right to withdraw from the contract within 14 calendar days from the day you receive the artwork, without giving any reason.
- Legal Exception: This right does not apply to custom artworks, commissioned pieces, or artworks made to specific customer specifications. These sales are final and cannot be returned or refunded.
2. Conditions for Returns
For a return to be accepted, the artwork must meet the following requirements:
- You must notify us of your intent to return within the 14-day window via email at: Albaruiz.art@gmail.com
- The artwork must be in its original, unaltered condition, without any damage.
- The artwork must be returned in its original packaging and all protective wrapping to ensure safe transit.
3. Return Shipping Costs and Liability
- Costs Borne by the Buyer: All return shipping fees are the sole responsibility of the buyer, as permitted by law.
- Recommended Shipping Insurance: The buyer remains responsible for the artwork until it safely reaches our studio. We highly recommend using a tracked shipping service with full insurance coverage for the total value of the artwork. We are not liable for items lost or damaged during the return transit.
4. Refund Process
- Once we receive the artwork and verify it is in its original, undamaged condition, we will process your refund.
- Withholding Funds: We reserve the right to withhold the refund until we have received the artwork back or until you supply proof of return shipping.
- Diminished Value: If the artwork arrives damaged due to inadequate packaging by the buyer, the reduction in the artwork's value will be deducted from the total refund.
5. Artworks Damaged in Initial Transit
If the artwork arrives damaged due to the transport courier during initial delivery:
- You must notify us within 24 hours of delivery.
- Please provide clear photographs of the damage to the artwork as well as the condition of the external box/packaging.
- We will arrange for the collection of the piece and provide a solution (repair, replacement if applicable, or a full refund).
